As ’n organisasie, en die meer as 300 000 lede wat AfriForum verteenwoordig, is die organisasie diep bekommerd oor die optrede en mislukkings van Cele.

Dit het onlangs aan die lig gekom dat die Suid-Afrikaanse Polisiediens (SAPD) die afgelope twee jaar meer as 1 300 speurders verloor het. In ’n land waar 67 mense daagliks vermoor word, is dit onaanvaarbaar dat hierdie personeel nie vervang is nie.

In nog ’n skokkende voorval by ’n gemeenskapspolisiëringsvergadering in Gugulethu, het Cele herhaaldelik vir die leier van ’n burgerregte-drukgroep wat hom gekritiseer het, geskree “shut up!” en “get out!”.  Die betrokke leier is toe met geweld deur SAPD-beamptes uit die openbare vergadering verwyder. Hierdie ontstellende voorval was slegs die jongste in ’n lang lys van voorvalle en mislukkings, wat AfriForum in hul brief uiteensit, wat Cele se ongeskiktheid vir sy posisie demonstreer.

Voeg hierby dat Cele in 2020 ook op ’n vergadering van die boeregemeenskap in Normadien teen besorgde landsburgers uitgevaar het. Cele is die afgelope paar dae ook na bewering betrek by ’n 2010 Fifa Wêreldbeker-akkommodasietenderskandaal van R47 miljoen.

In 2012 het die Openbare Beskermer bevind dat Cele, wat destyds polisiekommissaris was, skuldig was aan onbehoorlike gedrag en wanadministrasie met betrekking tot ’n huurkontrak van R500 miljoen vir die Sanlam Middestad-gebou in Pretoria, en ’n raad van ondersoek het Cele ongeskik vir sy amp bevind, wat gelei het tot sy skorsing. Hierdie is slegs ’n paar voorbeelde op Cele se groeiende lys van mislukkings.

“Bheki Cele het al keer op keer gewys dat hy nie die vaardighede en temperament het om sy kritieke posisie te vul nie. Ministers wat nie opgewasse is vir hul posisies nie, het lank genoeg misluk en hulle growwe wangedrag het vir lank genoeg ongestraf verby gegaan,” sê Jacques Broodryk, veldtogtebestuurder by AfriForum.

“Hoe is die misdadigers van hierdie land veronderstel om ’n minister van polisie te vrees wat so maklik sy humeur verloor en op besorgde burgers skree? Die mense en gemeenskappe van Suid-Afrika verdien baie, baie beter,” sluit Broodryk af.

AfriForum is taking legal action against the requirement for license cards to be renewed every five years. The civil rights organisation filed court papers in which it demands a declaratory order that the Road Traffic Regulations that limit the period of validity of license cards to five years are beyond the legislature’s power, unreasonable, arbitrary and vague. The application further seeks a declaratory order that motorists cannot be penalised or fined for not being in possession of a renewed driving license card.

Strong legal and practical grounds form the basis of AfriForum’s legal application:

  • From a legal point of view, the Road Traffic Act 93 of 1996 and the regulations are too vague to be workable. The Act does not clearly distinguish between a “driving license” and “driving license card”. Neither does it explicitly state that motorists must apply for new license cards upon expiry or that it is a crime to drive with an expired license. Moreover, it does not prescribe any fines, penalties or sanctions for doing so. As such, the legislation is neither clear, nor concise or internally harmonious enough to enable the general public to know with a degree of certainty what is expected of them. Furthermore, the legislation is argued to be ultra vires. In other words, the government cannot punish members of the public if it cannot clearly show what law is being transgressed. Any such punishment amounts to a violation of rights.
  • From a practical point, the Department of Transport’s well-documented administrative, operational and financial struggles make it unfeasible, unreasonable and irrational to require drivers to renew their license cards every five years.  
  • The application further stresses that many countries around the world have opted for a license card system that does not require such frequent renewals as South Africa does.  

If AfriForum’s succeeds in its legal action, it will be a watershed moment. This would mean that the government has been wrongfully punishing the public for more than 20 years.
